Officials are well aware that incidences of rape and assault become more common in the wake of hurricanes such as Irma and Harvey. When state-wide evacuations for Hurricane Irma began last week, Florida’s Polk County sheriff announced that sex offenders would be banned from all shelters. “We cannot and we will not have innocent children in a shelter with sexual offenders & predators. Period,” he tweeted.<br />
<br />
It’s still too early to tell if law enforcement and first responders in Florida will be successful in preventing a rise in these crimes of opportunity, especially in the hurricane’s aftermath when a sense of lawlessness tends to pervade communities. In 2005, in the wake of Katrina, reports began to emerge about the uptick in incidences of rape and sexual assault. Some were victims who failed to evacuate, while others claimed to have been assaulted at shelters set up for evacuees. In one widely reported incident after Katrina, a perpetrator woke his victim in the shelter’s communal sleeping area in the middle of the night. He threatened her with a knife then raped her.<br />
<br />
“There were some lessons to be learned from Katrina,” Chau Nguyen of Houston Area Women’s Center told Newsweek. She says improved security and additional training for Harvey's disaster response appear to have prevented incidents of sexual assault from occurring at shelters in Houston. This issue is so thorny, fraught and sad: If a person is developmentally disabled and therefore not in step with others his or her age, is it any wonder they would, for instance, make inappropriate overtures, or even want to watch child porn, since they relate to the age of the kids in it, and yet are already sexualized young men and women?<br />

My name is Brian Kelmar, and I am the father of a 24 year old son who has autism and auditory and sensory processing disabilities. Our nightmare began almost six years ago, right after my son graduated high school. It’s a case of the “perfect storm” that resulted in my son being punished and treated as an outcast in our community and in society.<br />

Do words like “trusting, bullied, eager to please, and not understanding social situations” sound familiar? These words describe my son and how he interacts and/or experiences the world around him. Like others with autism, he had few friends growing up, let alone a girlfriend. That core need for friendship hasn’t changed. He continues to long to fit in and feel included, and have friends in his life that he can talk to. So, when a female friend of my younger son started texting my son, he was so happy that he found someone nice to talk to.<br />

The girl’s texts started innocently enough with just small talk. The communication began when he was away at a college summer orientation where he was learning about the autism program he was to begin in the fall. The texting from her soon became very sexually aggressive, and he did not understand what the texts were about. He answered her questions with short words or answers, such as “like”, “what”, “ok”, and “huh”? She pointed out to him, “you really don’t understand what I am talking about” in regards to her sexual statements like “friends with benefits” and “hooking up,” along with more graphic content which he did not understand. Abstract<br />
<b>OBJECTIVE:</b><br />
To investigate autism spectrum disorder (ASD) symptoms in juvenile suspects of sex offenses.<br />
<br />
<b>METHOD:</b><br />
A group of 175 juvenile suspected sex offenders (all males, mean +/- SD age = 14.9 +/- 1.4 years) was compared with a matched healthy control group (N = 500, mean +/- SD age = 14.0 +/- 1.4 years) and a group of children with DSM-IV-diagnosed ASD (N = 114, mean +/- SD age = 14.2 +/- 1.9 years) with respect to autistic symptoms as measured by means of a standardized questionnaire, the Children's Social Behavior Questionnaire. Furthermore, specific subgroups of sexual offenders, i.e., child molesters, solo peer offenders, and group offenders, were compared with regard to levels of ASD symptoms. The study was conducted from May 2003 to December 2006.<br />
<br />
<b>RESULTS:</b><br />
Significantly higher levels of ASD symptoms were found in juvenile sex offenders than in healthy controls, while levels were lower than in the ASD group (F = 148.259, p < .05). Solo peer offenders and child molesters scored higher on several subscales as well as on core autistic symptoms than group offenders (F = 5.127, p < .05).
<b>CONCLUSIONS:</b><br />

Amazon may have flopped with the Fire Phone, but don’t count it out of the telephony game just yet. Alongside Amazon unveiling its newest Echo device earlier today — the <a href="https://techcrunch.com/2017/05/09/amazon-unveils-the-230-echo-show-with-a-screen-for-calls-shipping-june-28/">Echo Show</a> with a seven-inch video screen — the company also announced Alexa Calling, free voice calls and messaging services that you use through all Echo devices (not just the Show), as well as for users of the Alexa app for smartphones.<br />
<br />
The feature is marked as “coming soon” on the <a href="http://www.amazon.com/alexacalling">Alexa Calling</a> product page, but we have been told by an Amazon spokesperson that, in fact, it’s coming online later today. In other words, well ahead of the newest Echo shipping.<br />

Meanwhile, users of that newest Echo, the Echo Show, which has the screen and video feature, will get added services, it seems. The one that has jumped out at me first is called “Drop In” — which lets you make a call to someone without them even answering the phone first. Think of it as the 21st century tech equivalent of someone coming to your house and either peeking through the front window as they’re knocking, or maybe just walking straight in, 1970s sitcom-style.<br />
<br />
Alas, this is not being positioned as something mildly intrusive, nor as a creepy big brother-style service (which is the worst-case scenario and one that Amazon has been taking pains to avoid in all of its Echo and Alexa products). Rather, Amazon emphasizes that it is opt-in, and a way to communicate with only the very closest members of your family.<br />
<br />
Examples of usage can include checking in on elderly relatives, or letting your family in another room know it’s time for dinner — or perhaps making sure you kid is really doing homework and not watching YouTube. Let’s see how people use it as it rolls out.<br />
<br />
Amazon says that Alexa Calling can be used on any Echo device and the Alexa app once the user and the user’s intended contact have both enabled Alexa calling and messaging. In other words, for now (emphasis on for now; Amazon is nothing less than massively ambitious), it sounds like you can’t use your Echo Dot to call your friend’s landline. But you can use it to call or message your friend if she has a smartphone with the Alexa app downloaded (and Alexa Calling enabled).<br />

(Interesting side note: This seems to be a very new use case for the Alexa app, which to date has mainly been positioned as a support for Echo owners, not a standalone app for other Amazon services. It’s been years since I’ve been asked the question and I thought I’d never hear it again.<br />
<br />
But sure enough, just a couple of weeks ago, I was asked, “Do you know if anyone has died in this house?” It was not too long ago that another buyer client refused to enter a house because it was diagonally across the street from an old cemetery, even though she had liked the listing tremendously online.<br />
<br />
In real estate, such concerns fall under the category of stigmatized properties that, by loose definition, can be the site of a murder or suicide, criminal activity or even a rumored ghost.<br />
<br />
I don’t know why I was initially surprised by these situations, considering my own case history. My wife and I purchased our first home from a friend in Brooklyn Heights, across the river from lower Manhattan. It featured a rental duplex and our upstairs tenants were a wonderful, cultivated couple, he a designer for The New York Times and she a filmmaker. Her official introduction to me the day we moved in was to ask whether the former owner told us that the house was haunted. I simply laughed. Within a short time, I was not laughing about the matter, with clear evidence that paranormal activity was taking place on the premises. (That’s grist for another story.)<br />

While there is great debate about how a stigma can decrease a property’s value, actually this one helped us. We had opened an antique shop on the first floor of the house, and The New York Times featured us with a half-page story about a daring young couple who rustled up their deferred down payment for the house by selling off their collection of antiques in the shop and, by the way, the house was reportedly haunted. The next day, curious readers were lined up to get into our little shop.<br />
<br />
Disclosing information about a stigmatized house depends on many factors, mostly on state laws and circumstances surrounding the perceived stigmatization. Connecticut’s “ghostbusters law” requires agents to inform buyers in writing of suicides or homicides and other felonies if requested by the buyer.<br />
<br />
However, about 30 states across the country, including New York, have specific laws stating that sellers and their real estate agents cannot be held liable for failing to disclose such nonmaterial or nonphysical defects about a house. Some years ago, in a notorious case, a Poughkeepsie homeowner had committed a series of murders and buried the bodies in the basement. The subsequent buyer of the house attempted to sue the realtor for not being informed of this.<br />
<br />
Effects of so-called stigmatization have varied. The house in which the Charles Manson murders took place in 1969 had a successful sales history after the fact. The house had been rented from a landlord who moved back in just three weeks after the murders and lived there happily for the next 20 years. When the house was offered for sale after that period, it sold in two weeks.<br />
<br />
But most of the time, highly stigmatizing events can cut as much as 15 percent to 25 percent from the price a home would otherwise fetch. The largest markdowns, according to appraisers, are associated with explosive cases that receive broad media attention, such as the “Amityville Horror” house. Another case is the property at which Nicole Brown Simpson and Ron Goldman were murdered. In that case, the house was on the market for two years after the murders and sold for $200,000 less than what had been paid.<br />
<br />
As far as actual physical defects are concerned, in 2002, New York State enacted the Property Condition Disclosure Act that requires sellers to inform buyers of known conditions of the property before the contract is signed. However, there is an option, which most lawyers recommend, that the seller decline submitting the form, but instead transfer $500 to the buyer at the time of closing.<br />
<br />
While disclosure laws cover a lot of territory, agents in most states notify buyers that they must do their own research about matters such as the quality of the local school system or if there are registered sex offenders living in the neighborhood.<br />
<br />
Ghostly stories can come from the most grounded of people. Gov. Andrew Cuomo revealed in an Associated Press interview that when he spends evenings in the Governor’s Mansion in Albany, reputed to be haunted, he is sometimes unsettled by unexplained activity.<br />

Prosecutors commit misconduct when in the course of their professional duties they act in ways that are inconsistent with ethical mandates they are obliged to obey. Such misconduct exists at and near the intersection of two sets of rules: one is the legal rules that bind prosecutors so as to ensure due process – the state and federal constitution, statutory law, rules of criminal procedure, judicial orders, and the like. The other is the ethical standards of the legal profession as expressed in each state bar’s rules of professional responsibility and similar professional codes.<br />
<br />
Often an act of prosecutorial misconduct will violate both legal and professional codes. Though, because the codes differ in some ways, sometimes an act of misconduct may violate one code but not the other. Prosecutors are required to abide by both.<br />
<br />
Enforcement of the two codes differs. When prosecutors violate legal rules as part of a criminal case, the primary recourse is for the criminal defendant to ask to have his conviction overturned (or if the trial is in progress, to ask the judge for a mistrial, to strike matters from the record, or to otherwise minimize the damage caused). When prosecutors violate professional rules, the bar complaint process is the primary enforcement mechanism.<br />

<b>Types of Misconduct</b><br />
Below is a list of some common types of prosecutorial misconduct. Prosecutorial misconduct comes in many forms, and this list is not meant to be exhaustive, nor is it designed to preclude other ways of describing and classifying misconduct.<br />

<br />
<b>Failure to disclose exculpatory evidence</b><br />
<br />
In Brady v. Maryland and a line of subsequent cases, the U.S. Supreme Court has held that the U.S. Constitution requires that prosecutors turn over to the defense evidence that tends to show the defendant is not guilty or deserves a lesser punishment. The failure to disclose “Brady material” is one common form of prosecutorial misconduct. This behavior also frequently violates professional rules which prohibit lawyers from disobeying obligations, obstructing access to evidence, and failing to comply with discovery, as well as professional rules which require prosecutors to make timely disclosure of all information that tends to negate guilt or mitigate punishment. <b>Introduction of false evidence</b><br />
<br />
In several cases including Napue v. Illinois, the U.S. Supreme Court has held that the U.S. Constitution prohibits prosecutors from introducing false evidence, including false testimony, and requires prosecutors to correct falsehoods. Such behavior may also violate professional rules which prohibit attorneys from offering evidence the lawyer knows to be false, assisting or inducing a witness to testify falsely, or eliciting false testimony without taking measures to correct it. <br />
<b>Improper argument</b><br />
<br />
In opening and closing statements at trial (and other similar circumstances), a prosecutor’s use of certain types of prohibited modes of argument may constitute prosecutorial misconduct. For example, a prosecutor may not: assert facts not in evidence, misstate the law, vouch for the credibility of a witness, mischaracterize evidence, criticize the defendant for exercising his constitutional right not to testify, or engage in other similar prohibited behavior. This type of misconduct may violate federal and state constitutions as well as professional rules which prohibit these types of arguments. (See, e.g., ABA Model Rules 3.3 and 3.4)<br />

<b>Discrimination in jury selection</b><br />
<br />
When selecting a jury, prosecutors are prohibited from excluding potential jurors based on certain characteristics, including race, sex, ethnicity, religion, and other similar characteristics. When prosecutors do this, they violate the defendant’s constitutional rights as well as the constitutional rights of the prospective juror. This comes to light most commonly when African American or Latino prospective jurors are struck because the prosecution assumes that such jurors will be more sympathetic to a similar-raced defendant, more skeptical of authorities, or more lenient generally. Lawyers sometimes refer to a prosecutor’s discriminatory exclusion of racial minorities from a jury as a Batson violation, named after the Supreme Court case Batson v. Kentucky which established some rules to address the problem.<br />

<br />
<b>Interference with a defendant’s right to representation</b><br />
<br />
Though they have positions of authority, prosecutors are not neutral, they are participants in adversarial proceedings against criminal defendants. Prosecutors also are also sophisticated, repeat players in a criminal justice system that may be foreign, confusing and terrifying to defendants. Prosecutors may not discourage defendants from obtaining counsel, nor may prosecutors take advantage of a defendant who has not yet had the opportunity to avail himself of counsel. If a prosecutor knows that a defendant is represented, the prosecutor may not speak to a defendant about his case without the defendant’s attorney present. (See, e.g., ABA Model Rules 3.8(b), 3.8(c), 4.2 and 4.3)<br />

<br />
<b>Improper communications with a judge or juror</b><br />
<br />
Rules restrict the types of interactions that all attorneys, including prosecutors, may have with a judge or juror. For example there are rules which regulate ex parte communication with judges – that is, an attorney communication with a judge where the opposing counsel is not present. Similarly, during trial, it is generally improper for a prosecutor or any attorney to communicate with jurors in any manner other than before the judge, on the record. Furthermore, it is unethical and illegal for a prosecutor or any attorney to attempt to influence a judge or juror with improper inducements. (See, e.g., ABA Model Rules 3.5 and 8.4)<br />

<b>Improper use of the media</b><br />
<br />
Cases are meant to be tried in court, based on evidence, not in the press. Rules broadly prohibit prosecutors from engaging in public communications that may prejudice the defendant’s case or heighten public condemnation of the accused. Other than the basic details about a crime, most public communications about the defendant or the defendant’s case are improper and constitute prosecutorial misconduct. (See, e.g., ABA Model Rules 3.6 and 3.8(f))<br />

<b>Failure to train subordinates and maintain systems of compliance</b><br />
<br />
Prosecutors who have managerial responsibilities in district attorneys offices have a professional obligation to create systems in those offices that ensure that all lawyer and nonlawyer professionals are aware of and comply with rules of professional conduct. Prosecutors who supervise subordinates may not encourage or ratify misconduct by subordinates and must make reasonable efforts to ensure that subordinates abide by ethical rules. <b>Failure to report a violation of the rules of professional responsibility</b><br />
<br />
In many states, professional rules require that members of the bar inform the appropriate authorities if they become aware that another attorney has committed a serious violation of those professional rules. When prosecutors witness or learn of misconduct and fail to report it, in certain instances, they too may be guilty of misconduct. (See, e.g. ABA Model Rules 3.8)<br />

Early in the evening on Oct. 1, 1984, Catherine Fuller, a 48-year-old mother of six, was robbed, sodomized with a foreign object and beaten to death in a garage off an alley in Washington, DC. After police concluded that Fuller had been attacked by a group of young men, prosecutors obtained two guilty pleas and eight convictions.<br />
<br />
On Wednesday the Supreme Court will hear an appeal by seven of those men, who argue that prosecutors violated their right to due process by withholding evidence that would have cast doubt on the government’s allegations. The case shows why, more than half a century after the court told prosecutors they have a constitutional duty to share evidence that might help defendants, prosecutors have little incentive to take that duty seriously.<br />
<br />
In the 1963 case <a href="https://en.wikipedia.org/wiki/Brady_v._Maryland">Brady v. Maryland</a>, the court held that “suppression by the prosecution of evidence favorable to an accused . . . violates due process where the evidence is material either to guilt or to punishment.”<br />
<br />
The court later explained that evidence is ‘‘material” when there is “any reasonable likelihood that it could have affected the judgment of the jury.”<br />
<a name='more'></a><br />
It seems clear that the evidence withheld from the men accused of attacking Catherine Fuller meets that standard. The suppressed evidence included, for example, information that would have further undermined the credibility of purported eyewitnesses who implicated the defendants.<br />
<br />
The jury, which deliberated for a week and acquitted two of the 10 defendants, evidently had trouble believing the government’s witnesses, who contradicted themselves, each other and the physical evidence.<br />
<br />
It is hardly a stretch for the defendants’ lawyers to suggest that the jurors would have been even more skeptical if they had known one of the witnesses “was high on PCP while she met with investigators and identified photographs and suspects,” that the same witness had asked a friend to lie about hearing a defendant’s confession or that the aunt of another witness contradicted his claim that he had told her about seeing the crime.<br />
<br />
Prosecutors also kept jurors from hearing the accounts of witnesses who were in the alley at the time of the attack but did not see a group of men. Even more egregiously, the government suppressed information about two plausible alternative suspects, including one who was convicted of robbing and assaulting two other middle-aged women in the same neighborhood within weeks of Fuller’s murder.<br />
<br />
In 1992 that man “forcibly sodomized and beat to death a woman in an alley three blocks from where Mrs. Fuller had been found.”<br />
<br />
By 2010, all but one of the surviving prosecution witnesses had recanted, saying they had been pressured into falsely implicating the defendants. A DC Superior Court judge nevertheless rejected the defendants’ motion to vacate their convictions, a decision the District of Columbia Court of Appeals upheld in 2015.<br />
<br />
Amazingly, both courts concluded that the suppressed evidence, although favorable, was not material, which suggests how permissive that standard can be in practice. In a brief supporting the defendants’ appeal, the Texas Public Policy Foundation argues that the “materiality” standard should be replaced with a presumption that withholding favorable evidence violates due process unless the government can show beyond a reasonable doubt that the omission did not affect the outcome.<br />
<br />
“For an unethical or indifferent prosecutor,” the brief says, “a pretrial materiality requirement is an invitation to withhold favorable evidence.” Even assuming the suppressed evidence later comes to light, the government in all likelihood will prevail on appeal: A 2014 study of “145 decisions in which prosecutors were found to have withheld favorable information” found that 86 percent deemed the evidence not material.<br />
<br />

<b>Abstract:</b><br />
Persons with potentially harmful sexual interests such as attraction to minors are unlikely to seek or receive treatment before a sexual offense has been committed. The current study explored barriers to help-seeking in a sample of 372 individuals in treatment for sexual offending. Results revealed that the shame and secrecy resulting from stigma associated with pedophilic interests often prevented our respondents from seeking professional counseling, and only about 20% tried to talk to anyone about their sexual interests prior to their arrest. <br />
<br />
Barriers to seeking and receiving psychological services included concerns about confidentiality, fears of social and legal consequences, personal shame or confusion about the problem, affordability, and challenges finding competent therapists who were adequately equipped to help them. <b>Abstract</b><br />
Upon completion of their sentences and when attempting to ‘reenter’ society, offenders face large barriers, often referred to as the ‘collateral consequences’ of conviction. One of the largest barriers, given the stigma of a criminal record, is finding employment. <br />
<br />
The problem primarily arises because of increases in the use of background checks by employers and the use of a criminal record to eliminate candidates. Such a practice is partly understandable for employers, as a recent conviction is one of the best predictors of future criminal activity. <br />
<br />
However, <span style="color:black;background-color:#ffff04">recent evidence suggests that an offender’s risk of reoffending decreases over time and can eventually come “close enough” to that of one who has never offended, <b><u>even becoming lower than that risk for a random person within the general population</b></u></span>. <br />
<br />
However, no study has examined whether such knowledge has reached potential employers. Our study sought to determine whether knowledge such as this has reached potential employers and asked whether there are employment outcome differences for hypothetical applicants with older criminal records. <br />
<br />
Results indicate that those possessing older criminal records still face barriers when seeking employment.
